Definitions

The following definitions are used in this privacy statement:

Controller: the Dutch limited liability company “Breggz Hearables B.V.”, Chamber of commerce number: 83777903 with its address at Keizersgracht 165, (1016 DP) Amsterdam, to be reached via support@breggz.com.

Data Protection Officer; the data protection officer of Controller, to be reached via support@breggz.com.

1. General

This privacy statement describes how controller processes the personal data of its data subjects.

2. Personal data

2.1   Personal data means any information relating to an identified or identifiable natural person. controller may process the following data of data subjects:
a. Name;
b. Email address;
c. Phone number;
d. Address;
e. Bank account number (IBAN or CC)
f.  Cookie preferences;
g. Order history, including selected delivery options;
h. Personal earscan


2.2   Controller collects personal data from data subject in the following way(s):
a. The relevant data subject has provided the personal data to the controller through the use of the website for example by placing an order;
b. The relevant data subject has provided the personal data to the controller by contacting it with a request for information about the controller’s services or products;
c. Via cookies, according to the cookie preferences specified by data subject


2.3   The data subject is never obliged to provide the personal data. If data subject refuses to provide his or her personal data, controller may not be able to provide data subject with its products or services.

3. Purposes and lawfulness of data processing by controller

3.1   Controller processes the personal data of a data subject on one of the following legal bases under the general data protection regulation:
a. Consent;
b. The performance of a contract to which the data subject is party or the undertaking of pre-contractual steps at the request of the data subject;
c. The compliance with a legal obligation to which the Controller is subject, such as the legal obligation to keep adequate administrative records.;
d. The legitimate interest of the controller or a third party;
3.2   Controller processes data for the following purposes, on the basis of the specified legal bases:

4. Parties with access to personal data

4.1   In principle, controller will not provide the personal data to other parties. However, it may do so if:
a. The personal data are provided to processors engaged by the controller with whom a data processing agreement has been concluded or independent processors, e.g. delivery partners, IT service providers, payment companies or other service providers, external advisors, accountants or lawyers; or
b. The Controller is obliged by virtue of a legal obligation to pass on personal data to competent bodies, e.g. regulators or other public authorities; or
c. The personal data are provided to a company belonging to the Controller’s group or another department within the Controller’s company.
4.2 Controller provides your personal data, more specifically your name and address details to delivery services. This personal data may only be used by this third party for the purpose of the execution of the agreement with controller. Controller records the agreements it makes with these third parties with regard to personal data contractually.
4.3 For the purpose of carrying out payment transactions, controller provides your payment service provider with your contact data, payment data and a description or characteristic of the goods delivered. This payment service provider may only process this data for the purpose of executing and administering the payment.
4.4 Provision of personal data to the above parties will only be made for the purposes stated in this privacy statement, and to the extent permitted under this privacy statement and applicable laws and regulations, or if controller has a legal obligation to provide personal data to a competent authority. 5. Data subject’s rights

5.1 The data subject has the right to access, rectify and delete his or her personal data, in accordance with the provisions of the general data protection regulation. The data subject also has the right to object to the processing of his or her personal data.
5.2. The data subject may request controller to restrict processing and data portability. The latter means that the data subject has the right to receive the personal data that the controller holds about the data subject in a structured, commonly used and machine-readable form and, if necessary, to have the controller pass it on to another controller.
5.3 If the data subject has given consent to the processing of his or her personal data, the data subject has the right to withdraw this consent at any time.
5.4 If the data subject wishes to exercise any of these rights, or if the data subject has any questions about this privacy statement, the data subject can reach controller at support@breggz.com or Keizersgracht 165, 1016 DP, Amsterdam.
5.5 Data Subjects have the right to file a complaint with the Dutch supervisory authority, autoriteit persoonsgegevens, via: www.autoriteitpersoonsgegevens.nl/.

6. Storage period

Personal data will not be stored for longer than (i) necessary for the provision of controller's services and products or (ii) as long as Controller is required by law to keep the personal data. Thereafter, your personal data will be deleted. In doing so, controller has established the following time periods:
a. Personal data provided by you for the purpose of ordered services and products: [six months] after the service or product has been provided, with the exception of the legal obligation to keep records (7 years);
b. Personal data provided by you for the purpose of a question or request: fourteen days after your question has been answered or your request has been fulfilled;
c. Personal data provided by you through your device by visiting the Website: within one year after receipt;
e. Personal data provided by you with the consent to use it to keep you informed about Controller's services and products: until the moment you withdraw the consent.

7. Cookies

7.1 Controller uses so-called ‘cookies’. With these cookies, in accordance with the preferences specified by data subject, controller automatically collects certain data about data subject's history of activities on the website and third-party apps. Thus, personal data of data subject may be collected while data subject is using the website or apps or if they are running in the background on data subject's device. This data may be combined by controller with other data about the data subject's device, such as an IP address. If this requires the consent of data subject, controller will seek it in advance.

8. Security

8.1 Controller takes both technical and organisational measures to protect your personal data against loss, manipulation, unauthorised access, etc
8.2. If there is any potential leakage of personal data, such as when there is hacking and/or theft, controller will immediately notify the authorities and you.

9. Amendments to the Privacy Statement

9.1 Controller reserves the right to amend this privacy statement. Controller shall announce such modification in accordance with the law. Any amendment will be announced on this page and a clear notification will follow via a banner on the website in case of a material change to the privacy statement. Controller therefore advises the data subject to regularly check this page to see whether any amendments have been made.
9.2 If the data subject continues to use the website and/or services of controller once the amendments are in force, this means that data subject accepts the amendments. If data subject does not agree to these changes, it should terminate its use of the website and/or services.
